These General Terms and Conditions (hereinafter “GTC”) are the terms of ORI-GEL International AG.

2. Conclusion of the contract

Click on the name of the product or the image of the product to find out about the essential features of the product or service you want to order, plus the full amount of the purchase price including tax, shipping time, and other terms. The Buyer can place the product in the virtual basket by clicking on the “Cart” or the cart icon. When you place the product in your cart, an information window will appear informing the customer that the product has been placed in your virtual cart. In this interface, the Buyer can choose to continue to inquire in the Web Store (“Continue Shopping”) or to complete the inquiry and start the order process by clicking the “Cart / Checkout” button. If the Buyer has chosen the latter option, the contents of the shopping cart will be displayed where you can check the contents of your shopping cart (designation of the selected product, number of pieces; price per piece, gross price to be paid, product photo, etc.). On the cart page, the buyer can modify the order and delete the item from the cart. Once the Buyer has found that everything is OK, click on the “Checkout” button to start the order and log in to your account or make a purchase without registering with the requested information.

Registration is not a prerequisite for purchase. If the Buyer is logged into your account or has provided all the necessary personal information, you must provide shipping details by clicking “Next” if you have indicated that the billing address is different from the shipping address. Once the shipping details have been provided, the Buyer will have to select the payment method of their choice from the available options and then click on the “Submit Order” button to finalize your order and send it to Origel.
By clicking on the “Submit Order” button, you place an order that is considered an offer from the Buyer. However, this offer does not automatically mean that ORIGEL has accepted the Buyer’s offer.

3. Binding of tenders, confirmation, conclusion of contract

After the Buyer has placed his order, ORIGEL will confirm this to the Buyer by automated email within 48 hours confirming that ORIGEL has received the order sent by the Buyer. The automatic email will also include details of your order. This automated email does not constitute acceptance of the Customer’s order, but merely informs the Customer that your order has been received by ORIGEL. Receipt of your offer / order to ORIGEL will result in a Buyer commitment.

ORIGEL accepts the Buyer’s offer (order) via a separate acceptance email. The contract will be concluded upon receipt of a specific e-mail sent by ORIGEL to the Purchaser regarding the acceptance of the offer by ORIGEL and not upon receipt of the order confirmation e-mail (within 48 hours). The order is a contract concluded electronically.

4. Order data storage, digital data content

Order data is stored by ORIGEL. Once you have provided ORIGEL with your email address, ORIGEL will send you all relevant details of your order via email as mentioned in section 3, which you can print out if necessary.

The ORIGEL Web site (www.origel.ch) runs on all software environments and operating systems that display html-based web pages. The ORIGEL web site is not responsible for any software failure that may occur for any reason. In the event of a failure, ORIGEL requests its Customers to inform ORIGEL at info@origel.ch as soon as possible to rectify the problem and to take appropriate action.

5. Right of Withdrawal

The right of withdrawal applies to natural persons as Buyers (consumers) and applies to the person who purchases, orders, receives, uses, uses, and is the recipient of any commercial communication or offer related to the goods.

Failure by the Buyer to submit a cancellation notice within the specified time limit shall constitute a failure to comply with the conditions for exercising the right of cancellation and shall result in termination of your contract. In the event of a written cancellation, it shall be deemed to have been validated by the deadline if the Buyer submits a statement to this effect to ORIGEL during the Cancellation Period (even on the 8th calendar day).

The cost of returning the Product shall be borne by the Customer and shall not be refunded to the Customer by ORIGEL.

If the Buyer withdraws from the contract, ORIGEL will refund the full amount paid by the Buyer in exchange for the Product in return in its original, intact, unpackaged packaging, but not later than 8 (eight) days from the date of receipt of the returned Product. .
It is not possible to take back unopened products in unopened packaging for health and hygiene reasons.

ORIGEL reserves the right to withhold the purchase price of the products until they have received the product back. In the case of payment by credit card or prepayment, ORIGEL will always refund the amount returned to the bank account specified by the Customer at the time of payment.

The Buyer must enclose the delivery note with the product to be returned and, if possible, the reason for the return. An indication of the reason for the return, ie the reason for the right of withdrawal, is optional, so failure by the Buyer to indicate the reason for the return does not constitute a loss of his right of withdrawal or any consequential impairment of his right.

6. Shipping, and Shipping Costs

ORIGEL informs the Buyer of the delivery times during the respective order process by email, based on information provided by the delivery service provider.
If the specified delivery time cannot be met, ORIGEL will notify you by email.

Shipping costs:
In all cases the ordered products are delivered by mail. Depending on the number of the order, a given order is shipped in multiple unit packages.
The delivery fee for the product, regardless of the quantity of products ordered, is a flat rate of EUR 7 per package. This amount only partially covers the actual postage / delivery and packaging charges, but the remainder is borne by Buyers. If, after an order, ORIGEL has to deliver the order in several steps for technical or logistical reasons, ORIGEL will, of course, charge shipping costs only once (after each delivery).

Upon receipt of the product by the Buyer or a third party commissioned by the Buyer or by signing a document certifying receipt, the Product shall be received by the Buyer. If the Buyer experiences damage to the product or packaging during the receipt, you must ask the courier to record the damage. If, upon receipt, the packaging or product is visibly damaged and the damage occurred prior to receipt of the goods, ORIGEL will provide the product free of charge.

7. Reservation of Ownership

Until the purchase price is paid in full, the product is ORI-GEL International AG. owns. However, if, for any reason, the Product is in the possession of the Buyer prior to the full payment of the purchase price, you shall be liable to ORIGEL for any and all damages for which no one shall be liable.

8. Prices, Payment, Payment Costs, Due Date

The prices displayed in the Webshop next to the products are in EUR and include the statutory VAT, plus shipping, which is not included in the price of the product, which is the cost over and above the price of the product. The price is the price shown at the time of order.

Payment for the product may be made by bank transfer, credit card (online payment) in EUR currency at the Buyer’s choice.

In the case of bank transfer, the Buyer must provide his order number in the bulletin.
In case of online payment, the purchase price of the products also includes the cost of online payment.
In the case of a bank transfer, the full cost of the bank transaction beyond the purchase price of the products shall be borne by the Buyer. The cost of a bank transaction depends on the charges of the transferring financial institution, the exact charge of which can be obtained from the financial institution initiating the transaction.

If the amount of the bank transfer by the Buyer and the purchase price differ, the ORIGEL Customer Service will attempt to contact the Buyer within 5 business days of receiving the money based on the order ID. If ORIGEL is unable to reach the Buyer Party and agree on the difference, then ORIGEL will transfer the full amount of the order to the Buyer account number.

If the order identifier is not provided by the Buyer in the Notice, and the ORIGEL Customer Service is unable to identify the order, ORIGEL will transfer the full amount of the order to the transferring account number.
The full cost of the financial transfer to the Buyer shall be borne by the Buyer in all cases, so ORIGEL will be able to transfer to the Buyer the price less the bank transfer fee

10. Law Enforcement – Complaint Handling
Purchaser may submit customer / consumer complaints about the product or ORIGEL’s activities to ORIGEL by email at info@origel.ch.
ORIGEL will respond to the written complaint within 30 days.
In the event of rejection of the complaint, ORIGEL shall inform the Purchaser of the reason for the rejection and of the authority or conciliation body that the Buyer may initiate, depending on the nature of the complaint.

12. Unilateral amendment of the Terms of Service

ORIGEL reserves the right to change these Terms and Conditions unilaterally at any time. The amended provisions shall apply to orders placed after it enters into force.
ORIGEL reserves the right to make any changes or repairs to the Web Store at any time without prior notice and to transfer the Web Store to another domain name.
